1. Acceptance of Terms

By accessing or using the Yewki mobile application and website (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Yewki is a ski and snowboard run tracking application that allows users to log runs, track performance statistics, and compare results with friends. The Service is currently in beta and features may change without notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating an account and to update it as necessary.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Interfere with or disrupt the Service or servers connected to the Service.
• Attempt to gain unauthorised access to any part of the Service.
• Upload false, misleading, or fraudulent run data or statistics.
• Harass, abuse, or harm other users through the social features of the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.

5. User Content

You retain ownership of the content you submit through the Service, including run data, statistics, and profile information. By submitting content, you grant Yewki a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content as necessary to operate and improve the Service, including leaderboards and social features.

6. Intellectual Property

The Service, including its design, logos, text, graphics, and software, is owned by Yewki and protected by intellectual property laws. You may not reproduce, modify, or distribute any part of the Service without our prior written consent.

7. Beta Service

The Service is currently offered in beta. This means the Service may contain bugs, errors, or incomplete features. We provide the beta Service on an "as is" basis and make no warranties regarding its reliability, availability, or fitness for a particular purpose. We reserve the right to modify, suspend, or discontinue the beta at any time.

8. Assumption of Risk

Skiing and snowboarding are inherently dangerous activities. Yewki is a tracking and statistics tool only — it does not provide safety guidance, trail recommendations, or avalanche warnings. You assume all risks associated with your activities on the mountain. Do not use the app in a way that distracts you while skiing or snowboarding.

9. Limitation of Liability

To the maximum extent permitted by law, Yewki and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to injury, loss of data, or loss of profits.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.
